Dear Mogo 2025 Reflections
TERMS AND CONDITIONS FOR THE “#DEAR MOGO 2025 REFLECTIONS CAMPAIGN”
These Terms and Conditions govern participation in the #Dear MOGO 2025 Reflections Campaign (“the Campaign”) offered by Mogo Auto Kenya Limited (“Mogo”). The Campaign is a community engagement initiative encouraging participants to share personal reflections. It is not a lottery, betting, gaming, or gambling activity. Participation is voluntary and free of charge and does not influence any customer’s loan eligibility, loan status, repayment behavior, or credit standing with Mogo.
The Campaign is available only during the Promotional Period (01 December 2025 – 15 December 2025) and may be modified or terminated at the sole discretion of Mogo.
ELIGIBILITY
1. The Campaign is open to the following participants:
a) Kenyan citizens or legal residents aged 18 years and above; and
b) Existing Mogo customers and members of the general public engaging with Mogo’s official social media platforms.
2. The following people are not eligible to participate or win in the Campaign:
a) Mogo contractors, agents, influencers, marketing partners,and their immediate family members
b) Mogo Employees
c) Any participant who submits abusive, defamatory, illegal, misleading, harmful, or otherwise inappropriate content
d) Participants using bots, automated tools, or artificial engagement mechanisms
PARTICIPATION REQUIREMENTS
1. To be eligible for the Campaign:
a) Participants must:
· Respond to reflection questions in the comments section of the official Mogo social media posts on Facebook & TikTok (including their biggest win, biggest struggle and what could make the next year better).
2. By participating, all participants confirm that:
a) The submission is original and not copied from any third party
b) No impersonation or false information has been provided
c) The Submission does not contain political messaging, hate speech, nudity, violence, confidential data, or sensitive personal information. Mogo has full discretion to reject or remove any submission without explanation; and
d) Mogo may use the submission for marketing, promotional, reporting, or internal purposes without additional compensation.
WINNER SELECTION PROCESS
Selection Criteria
Winners, will be selected based on the following criteria:
a) Authenticity and originality of the reflection
b) Relevance to the Campaign theme; and
c) Alignment with Mogo’s brand values and, where applicable, contribution to positive community or workplace culture.
Selection Process
· Selected at Mogo’s sole discretion. Public engagement metrics (likes, shares, comments) may not be considered to prevent manipulation.
Winner Announcement and Finality
· Winners will be announced on 22 December 2025. Mogo reserves the right to adjust the announcement timelines if required, without prior notice. Mogo’s decisions regarding winner selection are final and binding for all participants.
PRIZES AND CONDITIONS
1. External Prize Pool may include but not limited to:
· Medical assistance (e.g., contribution towards a medical bill);
· Business support (Boost ya Biashara);
· Christmas essential purchases;
· Education assistance (primary, secondary, or university fees);
· Community project support (e.g., boda boda stages); and
· Loan-related waivers or support.
The exact nature, value, and number of prizes shall be determined by Mogo and may vary between winners. Prizes are not exchangeable for cash. Any tax, compliance, or documentation requirements relating to the prize shall be the responsibility of the participant.
SUBMISSION VERIFICATION
1. By accepting these Terms and Conditions, you agree to cooperate with Mogo and to provide all documents, information, or clarifications reasonably required to verify your identity, eligibility, and authenticity of your Campaign submission.
2. Mogo reserves the right to request additional information to confirm the accuracy, originality, and compliance of any submission with these Terms.
3. Mogo may disqualify any participant or withdraw any prize where fraudulent, misleading, or inaccurate information is provided, or where a participant refuses to provide verification information when requested.
4. Mogo may conduct internal or external checks, including reviewing publicly available social media information, to validate submissions.
LIMITATION AND EXCLUSIONS
a) The Campaign does not apply in the following circumstances:
b) Submissions made outside the Promotional Period;
c) Submissions on fake, anonymous, or suspicious accounts;
d) Content violating platform rules or Kenyan law;
e) Participants manipulating engagement; and
f) Employees submitting via non-designated channels.
RIGHT TO MODIFY OR CANCEL
1. Mogo reserves the right to modify, suspend, or cancel the #DearMOGO 2025 Reflections Campaign at any time, without prior notice, for any reason, including but not limited to regulatory requirements, platform limitations, operational considerations, or business strategy.
2. In the event of modification or cancellation, any valid submissions received prior to such change shall be reviewed and processed in accordance with the Terms and Conditions in effect at the time the submission was made.
LIMITATION OF LIABILITY
1. Mogo is not responsible for any costs, damages, expenses, or losses arising from participation in the #DearMOGO 2025 Reflections Campaign, including but not limited to platform errors, delayed submissions, technical failures, device malfunctions, or misinterpretation of the Campaign rules.
2. Mogo makes no warranties, express or implied, regarding the Campaign, including but not limited to its availability, continuity, or suitability for any particular purpose. Mogo’s liability is strictly limited to awarding prizes (where applicable) in accordance with these Terms and Conditions.
PRIVACY AND DATA PROTECTION
1. You are hereby informed that Mogo shall process your personal data, including your social media handle, submitted content, and any additional information you may provide, for the purpose of verifying eligibility, administering and executing the Campaign, communicating with participants, carrying out marketing and promotional activities, fulfilling reporting obligations, and any other purposes set out in Mogo’s Privacy Policy available at https://www.mogo.co.ke/privacy-policy. By participating in this Campaign, you confirm understanding and acceptance of Mogo's terms.
2. For the above-mentioned purposes, Mogo may transfer and receive your data from third parties, including social media platforms, service providers, or regulatory bodies, insofar as such transfer is necessary for Campaign administration or compliance with legal obligations.
3. Mogo will ensure that all personal data is processed in accordance with the Data Protection Act, 2019 and all relevant regulations. You retain the right to exercise your data subject rights under this Act, including the rights to access, correction, objection, and deletion, subject to applicable legal limitations.
OTHER TERMS
1. The #DearMOGO 2025 Reflections Campaign may not be combined with any other promotional offers, rewards, discounts, or incentives unless explicitly stated otherwise by Mogo.
2. You agree that no indulgence, assent, express or implied, to any breach by Mogo of any of these provisions shall constitute a waiver, abandonment, or novation of any other breach or of any of Mogo’s rights.
3. You cannot transfer your participation rights or any prize under this Campaign to a third person without Mogo’s prior written consent. Mogo shall be permitted to transfer any of its rights and obligations herein to a third person or entity.
4. No Party may bind the other except as expressly provided in these Terms and Conditions.
5. These Terms and Conditions constitute the complete agreement between the Parties regarding the Campaign and replace all previous discussions, promises, or agreements on the same subject, whether written or oral. Each clause stands independently, and if any part is found illegal or unenforceable, the remaining provisions shall continue to be valid and enforceable.
6. These Terms and Conditions shall be governed and interpreted in accordance with the laws of Kenya. The Parties agree that any disputes or issues arising shall be handled exclusively by Kenyan courts, after first attempting to resolve the matter amicably through available dispute resolution mechanisms.
By submitting an entry to the Campaign, you acknowledge and agree to these Terms and Conditions.
